DMCA (Digital Millennium Copyright Act) Policy

AniPic (by Anix7) is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act (DMCA). If you believe that any content available on AniPic infringes on your copyright, we encourage you to contact us in accordance with the DMCA process outlined below.

This DMCA Policy explains how we respond to claims of copyright infringement. We respect the intellectual property rights of others and ask our users to do the same.

What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a U.S. law that provides a process for copyright owners to request the removal of copyrighted material from websites. It protects service providers like AniPic from liability for hosting infringing content when they act promptly to remove or disable access to the content after receiving proper notice from the copyright owner or their agent.

Filing a DMCA Takedown Notice

If you are a copyright owner or an authorized agent, and you believe that any content on AniPic infringes upon your copyright, you can submit a takedown request to us. Please ensure your notice is compliant with the DMCA by including the following information:

1. Your Contact Information: Include your full name, address, telephone number, and email address. This will allow us to get in touch with you if needed and is required for legal reasons.
2. A Description of the Infringing Material: Identify the content that you believe infringes on your copyright. Please provide enough detail for us to locate the content on our site, including the direct URL(s) to the specific image(s) or material(s) in question.
3. A Description of the Original Work: Describe the copyrighted work that you claim has been infringed. If you are the copyright owner’s agent, specify your authority to act on their behalf.
4. A Statement of Good Faith: Include the following statement in your claim: “I have a good faith belief that the use of the copyrighted material in question is not authorized by the copyright owner, its agent, or the law.”
5. A Statement of Accuracy: Include this statement: “The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.”
6. Electronic or Physical Signature: Provide your physical or electronic signature to validate your DMCA takedown notice.

Counter-Notification to Restore Content

If you believe that your content was wrongly removed from AniPic due to a mistaken DMCA takedown notice, you may submit a counter-notification. A valid counter-notification must include the following:

1. Your Contact Information: Provide your full name, address, telephone number, and email address.
2. Identification of the Removed Content: Identify the material that was removed or disabled and the location at which the material appeared before it was removed. You should include the URL(s) where the content appeared.
3. A Statement of Good Faith: Include the following statement: “I have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
4. A Statement of Consent: Include the following statement: “I consent to the jurisdiction of the federal district court for the judicial district in which my address is located, or if my address is outside of the United States, I consent to the jurisdiction of any judicial district in which AniPic may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
5. Electronic or Physical Signature: Include your electronic or physical signature as the owner of the material that was removed.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a lawsuit within 10 business days, we will reinstate the content that was removed.

Repeat Infringer Policy

We take copyright infringement seriously and have adopted a policy of terminating accounts and/or access to our services for users who are repeat infringers. If a user is found to repeatedly violate the intellectual property rights of others, their access to AniPic may be revoked.

Limitations of Liability

While we strive to remove or disable access to infringing content quickly and efficiently, AniPic cannot be held responsible for failing to promptly take action upon receiving incomplete or misfiled DMCA takedown notices. Furthermore, we reserve the right to refuse to process DMCA notices that do not comply with the DMCA requirements.

False Claims

Submitting a false DMCA claim is a serious legal matter. Any person who knowingly misrepresents that content on AniPic is infringing may be subject to legal liability for damages, including court costs and attorney fees. This applies to both the filing of false takedown notices and false counter-notifications.

International Considerations

AniPic is accessible worldwide. While we are bound by U.S. copyright law and the DMCA, we also respect the copyright laws of other countries. If you are located outside the United States and believe that content on AniPic violates your rights under your country's copyright laws, please contact us with as much detail as possible, including relevant legal information, and we will review your claim accordingly.
